Sentencing of Joshua McCarty

On March 21, 2022, Joshua McCarty, of Schenectady, was sentenced by the Honorable Mark J. Caruso to 25 years to life in prison based upon his convictions of Predatory Sexual Assault Against a Child and Endangering the Welfare of a Child following a jury trial in Schenectady County. The sentence handed down by Judge Caruso was the maximum allowed by law. Upon his release from prison, McCarty will be required to register as a sex offender. Additionally, a Full Stay Away Order of Protection was issued for 75 years on behalf of the victim.

On November 18, 2021, McCarty was found guilty of engaging in sexual conduct, including oral sexual conduct, with a female child between December of 2017 and June of 2019, when the child was between the age of 4 and 6 years old.  The child was known to him.  The investigation began when the child came forward and disclosed the sexual abuse by McCarty. In a statement made to Det. Matthew Thorne of the Schenectady Police Department Youth Aid Bureau, McCarty admitted to three acts of sexual contact with the child including one act of oral sexual conduct during that time. 

The case was tried by ADA Christina Tremante-Pelham and Daniel Lennon on behalf of the Schenectady County District Attorney’s Office. Attorney Trevor Hannigan represented the defendant. 

 At sentencing, ADA Tremante-Pelham asked the Court to impose a sentence that reflected the repeated and predatory nature of the defendant’s crimes along with his lack of remorse despite having previously admitted to three separate acts of sexual contact with the child. She also asked the Court to consider the lifelong effects this abuse will have on the child victim. In doing so, ADA Tremante-Pelham stated: “In handing down a sentence that is appropriate for Mr. McCarty I ask you to think about what his victim has been forced to deal with by the age of 8 years old including engaging in sexual acts between the ages of 4 and 6 years old, having to endure a Sexual Assault Forensic Examination instead of attending her kindergarten graduation and having to relive her abuse over and over while going through the court process. Her life is forever changed from the little girl she was before she was repeatedly sexually abused, and her abuser’s sentence should reflect that.”
