Arraignment of Malcolm Gadsden on Murder 2nd

On March 23, 2022, Malcolm Gadsden [DOB: 12/22/1971] was arraigned in Schenectady County Court by Schenectady County Court Judge Matthew J. Sypniewski. The arraignment comes after a Schenectady County Grand Jury returned an indictment against Mr. Gadsden on counts of Murder in the Second Degree, under New York State Penal Law Section 125.25(1), Tampering with Physical Evidence, under New York State Penal Law Section 215.40(2), and one count of Criminal Possession of a Weapon in the Fourth Degree, under New York State Penal Law Section 265.01(2). With respect to the top count of Murder in the Second-Degree Mr. Gadsden faces a maximum of twenty-five [25] years to life in prison.

The charges stem from events that took place during the evening of December 23 into the early morning hours of December 24, 2021, at or in the vicinity of 964 State Street Apartment 1F, in the City and County of Schenectady, New York, where it is alleged that Mr. Gadsden intentionally caused the death of January Butcher [DOB: 1/31/1981].

As with any indictment, the defendant continues to be presumed innocent until proven guilty at a trial.  The indictment is only a charge and should not be considered a finding of guilt.
